Where it is proved in court under Section 118A of the Evidence Act that a person has not been heard of for seven years by those who might be expected to have heard of him if he were alive. Where a court has issued a presumption of death order for a missing person.

Any other evidence of the missing person as may be required by the registrar
Fee
Presumed Death Registration: Kshs 1,500 (Additional Kshs 200 for death certificate)
